Michael Shore argues Federal Circuit appeal of venue transfer order violating state sovereignty

Shore Chan partner Michael Shore argued a Federal Circuit appeal of a district court order transferring a patent infringement suit brought by The University of Texas System from Texas to Delaware based on the patent venue statute. "This is not an Eleventh Amendment case. . . . Under the Constitution and the Judiciary Act [of 1789], States were left free to seek redress for their own grievances in any court that had the requisite jurisdiction. No limits were set of their powers of choice in this particular." The appeal has important implications on state sovereignty and IP investment.
